My Lord Duke,
I have had the honor of receiving Your Grace's Despatch of the 14h April last, marked "separate" accompanied by a Supplementary
Commission and Instructions dated 8th October 1862, framed for the
purposeof of dividing the Council of Vancouvers Island into two
distinct bodies, and creating an Executive and a Legislative Council.
3. And I beg further to report that under the authoritycontained contained in
the aforesaid Instructions, the Attorney General Mr Cary, being
absent on sick leave, and Mr David Babington Ring having been
provisionally appointed to act as Attorney General during Mr Cary's
absence, Mr Ring has been provisionally appointed by me to be ex
officio a Member of the Executive and Legislative Councils of
Vancouver's Island.
