Life Certificatesigned by Cook, justice of the peace for New Westminster, is not sufficient proof that Moody is alive and performing his duties in British Columbia.

In reply to your letter of the 22 Ult. enclosing a Life
Certificate of Colonel Moody, Commissioner of Lands etc in British
Columbia, signed by G.E. Cook, JP for Westminster, and requesting
that directions may be given for the payment of Col Moody's Salary
for the Quarter to 31 December last, I am directed by the LordsCommissioners
Commissioners of Her Majesty's Treasury to return herewith the
Certificate in question, and to acquaint you for the information
of the Duke of Newcastle that My Lords will require, as on previous
occasions, a Certificate signed by some Officer or Magistrate
residing in British Columbia, that Colonel Moody was in existence
and in the performance of his duties as Chief Commissioner of Lands
and Works for the period of which the Salary is applied for.The
The enclosed Certificate is one of the Forms furnished by the Pay
Office to Persons on the Superannuation List resident in the
Country to enable them to receive their Pensions.

That Messrs Cox & Co are aware that the certificate of Colonel Moodys existence should come from the Colony may be inferred from their letter 2079 which is annexed. The covering letter in which they applied for his salary for last June quarter—8020—is similar to that in which they have now applied for his salary for Decr quarter—2738—but as in the former case the Treasury did not object, I suppose the certificate itself was correct.

Draft, Elliot to Hamilton, 22 April 1862, forwarding certificate
showing date up to which Moody was chief commissioner of works
in British Columbia and asking that the necessary salary be
authorized.
Elliot to Cox & Co., 28 April 1862, advising that the
certificate should have been signed by an officer or magistrate in the colony, not
a justice of the peace, but to save further reference,
a certificate had been prepared in the Colonial Office and forwarded to Treasury.
